Terms of Service

1. Agreement to Terms

By creating an account or accessing Avokindo ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

Avokindo is operated by Avokindo Digital Sdn Bhd, a company registered in Malaysia.

2. Eligibility

You must meet the following requirements to use Avokindo:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the App under applicable laws
• Not have been previously banned or suspended from Avokindo
• Complete our mandatory facial verification process

We reserve the right to verify your age and identity at any time. Providing false information is grounds for immediate account termination.

3. Account Responsibilities

When you create an Avokindo account, you agree to:

• Provide accurate, current, and complete information
• Use only real photos of yourself (no stock photos, celebrity images, or AI-generated content)
• Complete facial verification using live selfie capture (liveness detection)
• Maintain the security of your account credentials
• Notify us immediately of unauthorized access
• Not share your account with others
• Not create multiple accounts or impersonate others

You are solely responsible for all activity that occurs under your account.

4. Platform Usage

4.1 Permitted Use

You may use Avokindo to:

• Create and attend events ("Generous Posts")
• Request experiences ("Grateful Posts")
• Connect with verified users
• Chat with matched users
• Share event moments and experiences
• Rate and review interactions

4.2 Prohibited Conduct

You may NOT:

• Harass, threaten, or abuse other users
• Post sexually explicit, violent, or illegal content
• Promote commercial services, spam, or solicitation
• Use the App for dating scams or catfishing
• Discriminate based on race, religion, gender, or orientation
• Share personal contact information before matching (bypassing the platform)
• Use bots, scrapers, or automated tools
• Reverse-engineer or attempt to hack the App
• Cancel events repeatedly or ghost attendees

Violation of these rules will result in account suspension or permanent ban.

5. Trust Score System

Your Trust Score (0-100) is calculated based on:

• Verification status (facial, phone, email, government ID)
• Event attendance and punctuality
• User ratings and reviews
• Response times to event interests
• Cancellation rate and behavior patterns

The Trust Score is protected and only modifiable by our backend systems. Attempting to manipulate your score through fraudulent activity will result in account termination.

A higher Trust Score unlocks better matches, increased visibility, and premium features.

6. Verification & Safety

6.1 Facial Verification

All users must complete AWS Rekognition-powered facial verification during onboarding. This includes:

• Live liveness detection (to prevent photo/video spoofing)
• Multi-photo validation (profile photos must match your verified face)
• Re-verification if suspicious activity is detected

Biometric data is encrypted and stored securely per GDPR/PDPA regulations.

6.2 Government ID Verification (Optional)

Premium users may submit government-issued ID for enhanced verification. This earns a verified badge and boosts your Trust Score. We handle ID documents with the highest security standards.

7. Content Guidelines

All content you post (photos, event descriptions, moments, messages) must comply with our Community Guidelines:

• No nudity, pornography, or sexually suggestive content
• No hate speech, racism, or discrimination
• No violence, self-harm, or dangerous activities
• No illegal activity or drug use
• No copyright infringement (use only your own photos/content)

We reserve the right to remove content and suspend accounts that violate these guidelines. Severe violations will be reported to authorities.

8. Subscriptions & Payments

Avokindo offers free and premium subscription tiers. Premium features include:

• Priority matching algorithm
• Unlimited event posts
• Advanced filters and preferences
• Government ID verification
• See who viewed your profile

Subscriptions are billed through the Apple App Store or Google Play Store. Refunds are subject to Apple/Google policies. You can cancel anytime in your device settings.

9. Account Suspension & Termination

We may suspend or terminate your account if:

• You violate these Terms or Community Guidelines
• You receive multiple reports from other users
• Your behavior is deemed harmful to the community
• You engage in fraudulent or illegal activity
• You fail re-verification after suspicious activity

Suspended accounts may be reinstated after review. Terminated accounts are permanent and you may not create a new account.

You may delete your account anytime. Deletion is immediate and irreversible, removing all your data per GDPR Article 17 (Right to Erasure).

10. Intellectual Property

All Avokindo branding, logos, designs, and features are owned by Avokindo Digital Sdn Bhd and protected by copyright and trademark laws.

You retain ownership of content you post, but grant Avokindo a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content for operating and promoting the App.

11. Limitation of Liability

IMPORTANT: Avokindo is a platform for connecting people. We are not responsible for:

• The conduct of users you meet through the App
• Any physical or emotional harm resulting from interactions
• Disputes between users over events or experiences
• Financial losses from canceled events or unfulfilled experiences
• Accuracy of user-provided information (despite verification efforts)

Use the App at your own risk. Always meet in public places, inform friends/family of your plans, and trust your instincts.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVOKINDO AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

12. Governing Law & Disputes

These Terms are governed by the laws of Malaysia. Any disputes shall be resolved through arbitration in Kuala Lumpur, Malaysia.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

13. Changes to Terms

We may update these Terms from time to time. We will notify you via:

• In-app notification
• Email to your registered address
• Prominent notice on our website

Continued use of the App after changes constitutes acceptance of the new Terms.
